To ensure the quality of our puppies, each of our Red-Dawn Golden parents are fully health tested and certified with OFA and DNA. Your Golden puppy will be thoroughly checked by a veterinarian and will be current on deworming as well as flea & heartworm prevention. We provide a two year written health guarantee (see details below) along with the following assurances: each puppy is raised using ENS (also known as the “Super Puppy Method”) for the first two weeks after they are born; puppies are placed with their new owners according to their scores on the Volhard Temperament test; diets consist of raw meat diet; puppies are trained to use a dog door and eliminate on both a grass and in a litter box; and each of our puppies are raised inside, extensively socialized, and maybe even a little pre-spoiled.
Red-Dawn Goldens Contract
General disclaimer
While Red-Dawn Goldens carefully screens each and every possible sire and dame considered for our breeding program, no breeder can ever guarantee that every puppy will be 100% free of any genetic defects. We work very hard to do everything within our power to alleviate this, but are unfortunately not in full control of the outcome.
Transferability of Guarantee
All guarantees and contracts are valid only with the original buyer and are not transferable to any other person or entity.
Veterinary Inspection
The Buyer agrees to take their puppy in for a preliminary examination with a veterinarian within 72 hours of picking up the puppy. This examination is to include a written assessment of both overall fitness and wellness and must be signed by the veterinarian. Failure to meet the 72 hour deadline and obtain written verification will void all assurances under this agreement, both express and implied. If the Buyer wishes to request a refund or exchange their puppy, they must include the written assessment along with their written notice/intent (see below).
72-Hour Full Guarantee/Money Refund
If any congenital health defects are found during the preliminary examination, the Buyer may provide written notice/intent within 72 hours to return their puppy for (i) full refund of the purchase price of $_____, or (ii) their choice of a puppy from a future litter at the Seller’s earliest reasonable convenience. If the buyer fails to return the puppy for any congenital defects discovered during the preliminary examination, any future claims under section 5 will be invalid and forfeit. Any amount refunded will be reduced by any incurred out of pocket expenses associate with the return of the puppy (including travel and shipping) incurred by the Seller. Any written notice of intent must be received within 72 hours of receipt of the puppy and must also include a copy of the written assessment from the preliminary examination. If the Buyer chooses to provide notification via email, the written assessment must be mailed separately via US Postal Service or express mail. Please note that any notices or documentation sent via US Postal Service or Express mail will be officially effective upon postmark or time of receipt by the carrier. Any notices sent via electronically will be officially effective at time of receipt by the seller.
General Health Guarantee
Once the puppy reaches 2 years old and following the initial preliminary examination, if the puppy is found to have a congenital defect that prevents him/her from participating in normal daily activities, Seller will provide a replacement from a future litter at the Seller’s earliest reasonable convenience. In addition to the written assessment from the preliminary examination, a written description of the defect and the resulting physical impairment must be provided along with any requests for a replacement puppy. The Buyer has the right to have the puppy examined by a veterinarian of his/her choosing at the Buyer’s expense. Should there be a disagreement between the Buyer and Seller, the Buyer agrees that any final determinations be made and the validity of all claims will be determined by mutual agreement of those veterinarians who provided opinions to both the Buyer and Seller. The cost associated with the deciding opinion will be paid equally by both the Buyer and Seller. The replacement puppy, if any, will be in accordance with section 9. The guarantee does not include: viral illnesses, bacterial illnesses, acquired illnesses, vaccinosis, allergies, bites, infection, herbias, hypoglycemia, Guardia, Coccidosis, ingestion of foreign objects, ingestion of food or chemicals, or physical injury contracted or incurred following Buyer’s receipt of puppy.
Hip Guarantee
Red-Dawn Goldens guarantees the health of Puppy’s hips in the following manner:
6.1. Hips will be certifiable at a level of borderline or better by the Orthopedic Foundation for Animals (“OFA”) prior to 24 months of age.
Responsibilities of Buyer
To avoid joint or health problems caused by certain activities, the Buyer agrees to the following terms. Failure to abide by any term will result in the voiding of any guarantee or assurance in this contract, written or implied:
7.1. Buyer must have Puppy examined by a veterinarian within 72 hours of receipt of Puppy.
7.2. Buyer will not take Puppy to any public place (such as parks, pet stores, or obedience classes) until the completion of puppy shots (approximately 16 weeks) to avoid exposing Puppy to illness.
7.3. Puppy’s weight will be maintained at an appropriate level for the Puppy’s build and height. At no time is Buyer to permit Puppy to become “overweight” or “obese.”
7.4. Puppy will not be permitted to jump higher than Puppy’s elbow height during the first 12 months of Puppy’s life.
7.5. Puppy will not participate in physically strenuous activity during the first 12 months of Puppy’s life. It is the responsibility of the Buyer to verify with Red-Dawn Goldens that a physical activity does not qualify as strenuous prior to partaking in such activity. Such strenuous activity includes, but is not limited, to:
7.5.1. Long distance running
7.5.2. Flyball
7.5.3. Agility
7.5.4. Frisbee
7.5.5. Dock diving
7.6. Puppy will not be subject to frequent stair climbing during the first 12 months of Puppy’s life.
7.7. Puppy will be fed with a size appropriate, high-quality dog food or raw diet that promotes healthy bone and joint development. Buyer must show proof of receipts of food purchases. Puppy may not be fed Corn, Wheat, Legumes, Peas or Soy.
7.8. Puppy will have annual veterinary check-ups with appropriate vaccinations and monthly administration of heartworm preventative.
7.9. Puppy will be kept free of all parasites.
7.10. Puppy will reside inside Buyer’s residence.
7.11. Puppy will not be subject to physical abuse.
7.12. Major trauma (example, car accident) immediately voids any Guarantee.
7.13. If hips do not meet the minimum standards listed in section 6, Buyer will provide reasonable written proof (such as veterinary documentation or affidavit) that all responsibilities listed in section 7.1 – 7.12 have been met within 30 days of such request’s postmark.
Health Testing
Health testing will be completed in the following manner. Failure to abide by any term will result in the voiding of this and any other Guarantee, written or implied:
8.1. All hip certifications as described in sections 6 will be at the expense of Buyer.
8.2. Test results that do not meet the guarantee certification minimums described in section 5 will be accompanied by written statement from a licensed veterinarian that took the x-rays or performed the examination and will be communicated to Red-Dawn Goldens within thirty (30) days of receipt of test results.
8.3. Red-Dawn Goldens will have the right to retest and re-certify Puppy at their discretion and expense.
Replacement of Puppy
If, prior to 24 months of age, it is determined that the Puppy has failed to meet the minimum requirements of section 5 or section 6, and Buyer is able to show that it has met the requirements of this agreement, the Puppy will be replaced in the following manner:
9.1. At expense of Buyer, Puppy will be returned to Red-Dawn Golden in healthy condition other than with respect to the health defects or issues giving rise to the return of Puppy.
9.2. Buyer will provide all health records for Puppy since original receipt of Puppy.
9.4. Buyer will be placed into the current waiting list for the next available litter.
9.5. Shipping expense of replacement puppy will be at the expense of Buyer.
9.6. Only one replacement puppy will be given to buyer, despite the number of health defects in the Puppy.
Right of Recovery
If Buyer cannot keep the Puppy then Seller will take back the Puppy at any time. There will be no cash refund nor will a replacement puppy be provided.
Puppy Pick Upon Deposit
11.1. Puppies are offered to Buyers in order of deposits received.
11.2. Sellers reserve the right to first pick of the litter for themselves.
11.3. Buyer must choose puppy during the designated one hour appointment at or near 8 weeks of age, or potentially lose their pick order.
11.4. Puppy must be paid in full and picked up by 8 weeks of age. Seller reserves the right to sell any Puppy not picked up by 8 weeks of age to an alternate buyer. Buyers who leave their pups after 8 weeks of age puppy choosing day agree to pay a $40 per day boarding fee.
Additional Agreements
12.1. Buyer agrees to notify Seller of change of contact information of email, phone, or address.
12.2. Buyer agrees to notify Seller of any health or temperament problem in Puppy.
12.3. Both Buyer and Seller must agree to any additions or modifications in writing.
12.4. This agreement will be governed by the laws of Texas with venue in the courts of Denton County.
Breeding Agreement
13.1. This Puppy is being sold for the purpose of a pet. Buyer agrees to not allow dog to reproduce unless the Puppy receives OFA CHIC.
13.2. Buyer agrees to purchase Puppy on AKC Limited Registration.
13.3 Buyer has no obligation to sexually alter Puppy.
13.4 If Puppy is sexually altered prior to 12 months of age, no skeletal health warranty will be honored
13.5 Puppy’s AKC limited registration papers can be transfered by breeder to AKC full registration papers once Puppy receives OFA CHIC
13.6 Puppy will be registered with the kennel name Red-Dawn in the AKC name.
